Terms Of Service

In this Agreement, “We”, “Us”, “Our” mean Kimmelnet Corp BDA Amazing Sojourns (“Agency”), “You”, “Your” mean the traveler and
anyone traveling under the same booking.

Kimmelnet Corp DBA Amazing Sojourns is an independent travel agency that contracts with third-party suppliers (each a “Supplier” and collectively, “Suppliers”) as a booking agent to provide travel products including but not limited to tours, cruises, hotels, airline tickets and rental cars. All reservation services provided, and travel services coordinated by us are subject to these Terms and Conditions.

Booking and Payment:

- By booking with us, you agree to these terms.

- We work with third-party suppliers like tour companies, hotels, and airlines.

- We will email you once your booking is confirmed.

- Our terms have priority over our suppliers' terms.

Rates and Inclusions:

- Prices include what’s specifically outlined.

- They usually don't cover things like visa fees, taxes, local charges, gratuities, and optional excursions unless stated.

 

Third-Party Suppliers:

- Suppliers are independent contractors, not our employees.

- All documents and tickets you receive are subject to the suppliers’ terms.

- Follow their rules and pay them on time, or your booking might be canceled.

 

Personal Information:

- We’ll use your personal info (like passport numbers) to arrange travel.

- This info may be shared with suppliers, and we’re not responsible for their privacy practices.

 

Groups:

- Group bookings have different terms; see your Group Sales Contract.

 

Reservations and Payment:

- Providing your credit card info means you agree to our terms.

- Prices will be converted to/from US Dollars at current exchange rates.

- Your booking isn’t confirmed until payment is received.

 

Cancellation and Changes:

- Changing or canceling a booking might cost $100 per person plus any supplier fees.

- No refunds for unused services.

- Not showing up for your travel is a "no-show" and might cost the entire booking amount.

 

Refunds and Chargebacks:

- Refund claims must be submitted within 30 days of your travel date.

- No refunds for cancellations due to fear of travel.

- You can’t dispute charges unless there’s fraud involved.

 

Legal Requirements and Responsibilities:

- Make sure your travel documents (passports, visas) are up-to-date.

- Any issues at airports or borders are your responsibility.

- We’re not liable for accidents, losses, or other issues caused by third parties.

 

Special Needs:

- You must inform us of any special needs before booking.

- There may be additional charges for special services or equipment.

 

Air Travel:

- Name changes on tickets are considered cancellations.

- Tickets are non-refundable and non-exchangeable once purchased.

- Be prepared for baggage fees and check airline policies.

 

Travel During COVID-19:

- Follow all travel guidelines related to COVID-19, including testing and quarantine requirements.

- We’re not responsible for pandemic-related issues affecting your travel.

 

Force Majeure:

- We’re not liable for issues caused by events beyond our control, like natural disasters or war.

 

Governing Law:

- This agreement is governed by California law.  Any disputes or lawsuits must be resolved through binding arbitration in Alameda County, California.

 

Acceptance of Terms:

- By booking with us or making a payment, you agree to these terms.
